I. Introduction
Data privacy is important to the Altec Family of Companies, including Altec, Inc., and its subsidiaries (collectively, “Altec,” “we,” “our,” or “us”). We are providing this Product Data Privacy Notice (“Privacy Notice”) to describe how Altec collects, uses, shares, and protects the Personal Data of our Customers in connection with their usage of Altec Products. “Products” include Altec’s equipment, software, tools, and components, as well as Altec’s services. As used in this Privacy Notice, “Personal Data” means any information relating to an identified or identifiable natural person.
II. Scope of this Notice
This Privacy Notice describes Altec’s practices for collecting, using, sharing, storing, and securing Personal Data of Altec’s Customers and the employees and independent contractors (collectively, “Employees”) who operate and interact with Altec Products on behalf of Altec’s Customers (collectively, “Product Users”). Such Personal Data may include contact information, user identification, authentication data, and data relating to the location, performance, usage, and operational status of Altec Products (collectively, “Product Data”) that Altec collects and analyzes on behalf of Customers that use Altec Products, and receive related Altec services (collectively, our “Customers” or “you”).
This Privacy Notice supplements, but does not replace, other Altec privacy notices, including the Altec.com Privacy Statement and Altec’s California Resident Privacy Policy, which may additionally apply to you. Additionally, Altec’s contracts with Customers may include terms and conditions concerning how Altec will collect, use, share, store, and secure Product Data in connection with providing services to the Customer.
This Privacy Notice does not address the data collection and usage practices or the privacy and security practices of Altec’s Customers that engage Altec to process Product Data on their behalf, or the data collection and usage practices or the privacy and security practices of any other third parties. Altec is not responsible for the privacy and security practices of its Customers or any other third parties.
III. Altec Does Not Provide Real-Time Monitoring Services
As a general rule, Altec does not actively monitor Product Data in real-time, and Customers must not rely on, nor in any way depend on Altec to act in real-time based upon the Product Data that Altec collects on any Customer’s behalf. Altec entrusts the safe operation and maintenance of Products to Altec’s Customers, which have the exclusive responsibility to ensure that all Product Users are competent and fit to safely operate and maintain the Products. Altec may (but has no obligation to) notify a Customer if Altec discovers unsafe operation or maintenance of a Product by a Product User. The absence of a notice from Altec related to unsafe Product operation or unsafe Product maintenance does not indicate that Altec believes a Product User is operating and/or maintaining a Product in a safe manner.
- ALTEC’S COLLECTION OF PRODUCT DATA IS NOT A SUBSTITUTE FOR PRODUCT USERS’ SAFE OPERATION AND MAINTENANCE OF EQUIPMENT. ALTEC IS NOT RESPONSIBLE FOR DISPATCHING EMERGENCY ASSISTANCE BASED ON ITS COLLECTION OF CUSTOMERS’ PRODUCT DATA.
IV. Product Data Collection
SOURCES OF DATA – Altec collects Product Data through the following online and offline data collection sources:
- Our Customers – Product Data may be collected directly from our Customers, including from forms submitted by our Customers and their Employees (e.g., during Customer onboarding; account creation, service requests), and data collected directly from Customer devices (e.g., mobile phones, personal computers, tablets).
- Application Software – Product Data may be collected from applications and platforms (e.g., Altec Connect, AXIS, third-party portals) that our Customers and their Employees access using computing devices, (e.g., desktops, laptops, mobile devices, portable devices) either directly or through APIs.
- Electronic Devices – Product Data may be collected from embedded devices and connected devices, including portable or permanently mounted AXIS Service Interface devices, data logging devices, black box recorders, Altec Load Moment and Area Protection System (LMAP) and telematics control units (TCUs) manufactured by Altec or third parties (e.g., GEOTAB, Samsara, Verizon Connect, Zonar).
- Other Sources – Product Data may be collected from other sources, including component manufacturers, third-party service providers, OEMs, suppliers, and Product distribution networks.
CATEGORIES OF DATA COLLECTED – The following categories of Product Data may be collected:
- Account Information – Information relating to your accounts with Altec (e.g., AXIS Service Tool Accounts, Altec Connect Website Accounts) and with third-party telematics sources if Altec will be accessing and consolidating Product information from third-party sources on your behalf. Such information may include: Customer contact name, company name, job title, industry, phone number, email address, physical address, demographic data, emergency contact information, company DUNS number (i.e., unique identifier for businesses), taxpayer ID number, account login information (e.g., encrypted password, PIN), and the Internet Protocol (IP) address of your device (i.e., unique identifier assigned to each device connected to a computer network).
- Product Identification Information – Identifying information about your Products, such as vehicle identification numbers (VIN), vehicle registration, unit serial numbers, specifications, TCU media access control (MAC) address (i.e., unique hardware identifier), and warranty information.
- Product Operation and Safety Information – Operational information generated by devices in Altec Products or received from Product Users or third-party sources related to the usage, performance, operation, health, safety, and state of the Product. Examples of information that may be collected include location information (including via GPS and cellular tower pings), operating mode, movement, safety system status, impact data, security/theft alerts, up/down times, performance, how the Product is driven, the environment in which the Product is driven, fuel consumption, odometer readings, oil temperature/pressure, diagnostic codes, machine position and load moment indicators, use of boom, use of outrigger, equipment pitch-and-roll, upper interlock systems, setup and configuration, defects, replacement parts needs, service information, and associated timestamps.
- Usage Log Data – Usage log data collected by the AXIS device or Altec Connect. Such data may include usage data generated by AXIS Service Interface Accounts, including user ID information, lanyard attachment, date, and time of last login, equipment information, usability data (e.g., session use, failed session attempts), and AXIS device information, including changes made by the AXIS device during each session.
V. Purposes for Which Altec Uses Product Data
Altec may use Product Data for the following business purposes:
- Services: Providing requested services to our Customers, including but not limited to: (1) analysis of Product Data to reduce risk, control costs, manage compliance obligations, and optimize fleet safety, performance, and productivity; (2) reporting, analytics, and recommendations to help manage fleet health; and (3) providing customized preventative maintenance services, prepaid maintenance services, and breakdown services for Customers requesting such services.
- Communication: Communicating with Customers and providing Customers with requested Products, services, support, and important updates (e.g., maintenance, warranty, recall).
- Customer Permitted Purposes: Using Product Data for purposes set forth in a written request or consent received from a Customer.
- Improving Products and Services: Maintaining Altec Products and services, and developing, improving, and offering new Products and service offerings.
- Other Business Purposes, including but not limited to troubleshooting and addressing equipment issues; cybersecurity; fraud prevention; analytics; honoring equipment warranties; providing information pertinent to an actual or potential merger, acquisition, or other reorganization; corporate governance; protecting our legal interests; and complying with legal, regulatory, and contractual obligations.
Where required, Altec will anonymize Customer information in a way that it cannot reasonably be associated with Customer, Product Users, or Customer’s Products. Altec may use and/or share de-identified and aggregated information with third parties for any legitimate business purpose. We will maintain and use this information in de-identified form and not attempt to re-identify the information, except that we may attempt to re-identify the information solely for the purpose of determining whether our de-identification processes satisfy the requirements of applicable law.
VI. How Altec May Share Product Data
Altec may share Product Data with the parties described below for one or more of the above-stated business purposes:
- Altec Family of Companies: We may share Product Data within the Altec family of companies (e.g., Altec Industries, Inc.; Global Rental Co, Inc.; Altec Capital Services, LLC; National Utility Equipment Company, LLC; Altec Worldwide, LLC; etc.) for business purposes.
- Service Providers: We may share Product Data with third parties who work on Altec’s behalf in connection with carrying out the above-stated purposes, such as organizations that: (a) provide our wireless services; (b) host and/or operate our databases; (c) send electronic communications on our behalf; (d) perform data analytics on our behalf; and (e) process, store, or manage Product Data on our behalf (collectively, our “Service Providers”).
- Original Equipment and other Manufacturers: We may share Product Data with third parties who analyze Product Data on our behalf in connection with the fleet management and maintenance services assistance we provide to our Customers (e.g., we may share Product Data with the original equipment manufacturer, component manufacturer, or one of their affiliates in order to enhance the engine diagnostic information we provide).
- Entities Involved in Any Business Transfers: We may share Product Data with a prospective or actual buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Altec’s, its affiliates’ or its subsidiaries’ assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by such entity about Product Users may be among the assets transferred.
- Emergency Responders: We may (but we have no obligation to) share Product Data with emergency service providers, such as law enforcement, roadside assistance providers, and ambulance providers to deliver related services (e.g., stolen equipment assistance services, emergency medical services).
- Law Enforcement and Governmental Authorities: We may share Product Data with law enforcement and other governmental authorities if we are required to do so by law or legal process; in response to government investigations; or as may be required for national security purposes.
- Legal Obligations or Safety Reasons: We may share Personal Data with third parties when we have a good faith belief that such disclosure of Personal Data is reasonably necessary to enforce or investigate a potential violation of any agreement you have with us; detect, prevent, or otherwise respond to fraud, security or technical concerns; support auditing and compliance functions; or protect the rights, property, or safety of Altec, its employees and clients, or the public against harm.
- Other Third Parties upon Customer Request or Consent: We may share Product Data with other persons or entities in accordance with any written request or consent received from a Customer.
- Third Parties Receiving De-identified Data: We may also share Product Data that has been de-identified (so it cannot reasonably be associated with our Customers or Product Users) with third parties, such as federal and state regulatory agencies and non-profit organizations for purposes such as education and research.
VII. California Privacy Rights
California residents may have additional privacy rights under the California Consumer Privacy Act (“CCPA”). For more information about such rights, please review Altec’s California Resident Privacy Policy, which includes additional disclosures specific to California residents.
VIII. How Altec Safeguards Product Data
We take reasonable security measures—including technical, physical, and administrative safeguards—to protect Product Data from unauthorized access, disclosure, alteration, and destruction. Although Altec maintains reasonable safeguards to protect Product Data, neither we, nor any other organization, can promise or guarantee that transmissions through public or wireless networks will not be intercepted by others.
You play an important role in keeping your information secure. You should not share your username, password, or other security information for your account with anyone. If you have reason to believe that your interaction with us is no longer secure, please immediately notify us by contacting us as detailed in the “How to Contact Altec” section.
IX. How Long Altec Keeps Product Data
Altec may keep the Product Data we collect for as long as necessary to reasonably provide our Products or services to you or our Customers, to operate our business, to enable us to communicate with you, for safety, research, evaluation of use, for troubleshooting purposes, and to satisfy our legal and contractual obligations. As required by applicable law, we will de-identify and/or dispose of the Product Data we collect when we no longer need it for the uses described in this Privacy Notice.
X. Children’s Privacy
Altec does not target or knowingly collect, use, or disclose Product Data from children, as defined by applicable law. If we become aware that we have unknowingly collected Product Data from a child, we will delete such information from our records.
XI. Additional International Considerations
This section provides additional information for individuals located outside of the United States. Except as set forth below, all other sections of this Privacy Notice apply, regardless of location.
Your Australian Rights
Consistently with this Privacy Notice, Altec may disclose Personal Data to overseas recipients, including those in the United States.
If you have any questions about this Privacy Notice, to access the Personal Data we hold about you or to seek correction of that Personal Data, or to complain about a breach of the Australian Privacy Principles or a registered APP code which binds Altec, please contact: privacypolicy@altec.com.
Your Canadian Rights
Altec and its data servers are located in the United States. Sending Personal Data outside of Canadian borders may increase the risk of disclosure of information because the laws in the destination country dealing with protection of information may not be as strict as in Canada.
Subject to applicable law, you may have the right to access your Personal Data (including the right to access your Personal Data in an electronic format and the right to an account of the use that has been made or is being made of the Personal Data and the third parties to which it has been disclosed), or update or correct your Personal Data (including, where applicable, the right to obtain deletion of any Personal Data collected otherwise than according to law), at any time upon request. If you have provided your consent to the processing of your Personal Data, you have the right to fully or partly withdraw your consent. Once we have received notification that you have withdrawn your consent, we will no longer process your Personal Data for the purpose(s) to which you originally consented unless there is another legal ground for the processing.
If you have any questions or complaints about this Privacy Notice or the handling of your Personal Data, if you wish to decline to have your Personal Data collected, used, or disclosed for the purposes set forth in this Privacy Notice or to withdraw your consent to our use of your Personal Data, or if you would like to request access to, deletion of, or update to any Personal Data we have on file, please contact: privacypolicy@altec.com. Where applicable, you may also contact the privacy officer to obtain information about Altec’s policies and practices with respect to service providers outside Canada.
Subject to applicable law, you may also direct complaints to the privacy commissioner of the jurisdiction in which you reside or other applicable supervisory authority.
We may need to obtain or confirm certain Personal Data in order to accommodate your request. We will not accommodate a request to change Personal Data if we believe the change would violate any law or legal requirement or cause the Data to be incorrect.
Your European Rights
This section provides additional information regarding Altec’s processing of Personal Data of persons located in the European Economic Area (EEA) in accordance with the EU Data Protection Regulation (GDPR).
Legal Bases for Processing
Our legal basis for processing Personal Data depends on the Personal Data involved and the context in which we process it. Where Altec acts as a controller, we process your Personal Data: with your consent; where necessary to perform a contract; to comply with our legal obligations; and where doing so is in our legitimate interests (including the purposes described in this Privacy Notice) and such interests are not outweighed by your rights and freedoms.
Special Category Data
Altec does not intend to collect any Special Category Data, which is any data that reveals your racial or ethnic origin, political opinions, religious, moral or philosophical beliefs, trade union membership, political views, the processing of genetic data, biometric data for the purpose of identifying a person, and data concerning health or a person’s sex life and/or sexual orientation. Please refrain from sending us any Special Category Data.
Cross-Border Transfers
Altec will transfer Personal Data to third parties located outside of the EEA only when it has ensured appropriate safeguards for such Personal Data through use of the standard contractual clauses or other lawful and approved methods. Rights Requests
Under the GDPR, you may have the right to access, rectify, delete, restrict, or object to our processing of your Personal Data. You also have the right to request that we not use your Personal Data for automated decision making, including profiling, which produces legal effects concerning you or similarly significantly affects you. If our processing of your Personal Data is based on your consent, you have the right to fully or partly withdraw your consent. Once we have received notification that you have withdrawn your consent, we will no longer process your Personal Data for the purpose(s) to which you originally consented unless there is another legal basis for the processing. Your Mexican Rights
This section provides additional information regarding Altec’s processing of Personal Data of persons located in Mexico in accordance with the Ley Federal de Protección de Datos Personales en Posesión de Los Particulares (LFPDPPP).
Except where an exemption applies, we process your Personal Data only with your consent which, under the LFPDPPP, exists when this Privacy Notice has been made available to you and you do not express opposition. You have the right to revoke your consent. Once we have received notification that you have withdrawn your consent, we will no longer process your Personal Data for the purpose(s) to which you originally consented unless an exemption applies, for example, where we must process your Personal Data to meet our legal obligations.
Under the LFPDPPP, you may also have the right to access, rectify, cancel/delete, or object to our processing of your Personal Data. To make a request to exercise these rights or to revoke your consent, please contact: privacypolicy@altec.com.
XII. Changes to this Privacy Notice
We may need to update this Privacy Notice from time-to-time as our business and Products or services expand or change, or as required by law. If so, we will post the updated version of the Privacy Notice on our website. Under certain circumstances, including if we make material changes to this Privacy Notice, we may also send a notice to you using the contact information we have for you. We encourage you to periodically review this Privacy Notice on our website for the latest information on our privacy practices.
